Terms of Service

Please read these Terms of Service ("Terms") carefully before using PropScribe. By creating an account or using the service you agree to be bound by these Terms.

1. The service

PropScribe is a software-as-a-service (SaaS) platform that assists property managers with creating property condition reports using artificial intelligence. The service includes:

• AI-assisted analysis of inspection photographs
• Automated generation of property condition report PDFs
• Contact and CRM management tools
• Maintenance job tracking
• Email delivery of reports

2. Accounts

You must create an account to use PropScribe. You are responsible for:

• Keeping your password secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access

You must be at least 18 years old and authorised to enter into this agreement on behalf of yourself or your employer.

3. Acceptable use

You agree to use PropScribe only for lawful purposes and in accordance with these Terms. You must not:

• Upload content that is unlawful, defamatory, or infringes third-party intellectual property rights
• Upload photographs of people without their consent where required by law
• Attempt to reverse-engineer, scrape, or extract data from the service
• Use the service to generate reports that you know to be false or misleading
• Share your account credentials with others

4. AI-generated content

PropScribe is a tool to assist property managers — it does not replace your professional judgement. You are solely responsible for the accuracy of any report you send or rely upon.

We make no warranty that AI-generated descriptions will meet any particular legal or professional standard, including those required by state tenancy legislation.

5. Subscription and payment

PropScribe is offered on a subscription basis. By subscribing you authorise us to charge your payment method on a recurring basis at the selected billing interval (monthly or annual).

• Subscriptions auto-renew unless cancelled before the renewal date
• You may cancel at any time; cancellation takes effect at the end of the current billing period
• Refunds are not provided for partial billing periods, except where required by Australian Consumer Law
• We reserve the right to change pricing with 30 days' notice

6. Data and privacy

Your use of PropScribe is also governed by our Privacy Policy, which is incorporated into these Terms. By using the service you consent to our collection and use of information as described in the Privacy Policy.

You retain ownership of all data you upload to PropScribe, including photographs, contact information, and reports. You grant us a limited licence to process and store your data for the purpose of providing the service.

7. Intellectual property

PropScribe, its software, design, and underlying technology are owned by Nathan Eldred and are protected by Australian and international intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the service.

Report PDFs generated by PropScribe using your data are yours to use as you see fit.

8. Limitation of liability

To the maximum extent permitted by law:

• PropScribe is provided "as is" without warranty of any kind, express or implied
• We are not liable for any loss or damage arising from your reliance on AI-generated content
• Our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages

Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded.

9. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend the service for maintenance, upgrades, or circumstances beyond our control. We are not liable for losses arising from service downtime.

10. Termination

We may suspend or terminate your account if you breach these Terms or engage in conduct we reasonably consider harmful to the service or other users. You may delete your account at any time from the account settings screen.

Upon termination, your access to the service ceases. We will retain your data for 30 days after termination before deletion, during which time you may request an export.

11. Changes to these Terms

We may update these Terms from time to time. We will give you at least 14 days' notice of material changes via email or in-app notification. Continued use of the service after the effective date of changes constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
